A letter with “section 129” in it looks frightening. In reality it is a warning with options, and a chance to sort the problem out before it gets worse.
Here is what a section 129 notice means and how to use the ten business days.
What is a section 129 notice?
Section 129 of the National Credit Act says that if you are in default under a credit agreement, the credit provider must first draw the default to your attention in writing.
It must propose that you refer the agreement to a debt counsellor, an ombud or another body to resolve the dispute or agree a plan.
Only after that can the lender start legal proceedings. That written warning is the section 129 notice.

What does a section 129 notice have to tell you?
It should say that you are in default, how much is owed and that you may take certain steps. It should be sent to the address you gave for notices.
Lenders must follow the rules on how it is delivered. That is why the notice address in your agreement matters.
What are your options?
| Option | What it does |
|---|---|
| Pay the arrears | If you pay what is overdue, plus permitted costs, the agreement can be reinstated |
| Agree a payment plan | A written arrangement with the lender |
| Refer to a debt counsellor | A counsellor can assess you for debt review |
| Refer to the Credit Ombud or a consumer court | An independent route to resolve a dispute |
| Dispute the notice | If the amount or the default is wrong |
How long do you have?
The lender cannot start legal action until 10 business days have passed since the notice was delivered. That is a minimum, not a deadline to wait out. Act in the first few days.
What are the 5 steps to take in those 10 business days?
- Read it carefully. Check the amount, the dates and the account details.
- Contact the lender. Ask for a statement and a payment arrangement.
- Check the arrears. Is the figure right? If not, say so in writing.
- Get advice. A debt counsellor can help you decide whether debt review makes sense.
- Keep records of every call, email and letter.
A short reply works:
“I received your section 129 notice dated [date] for account [number]. I can pay R___ each month from [date]. Please confirm in writing, and send me an up-to-date statement.”
Ignoring the notice does not make the debt go away. It leaves the lender free to go to court once the time has passed.

What if you never received it?
The lender must prove it delivered the notice in the way the law requires. If you did not receive it, tell the lender and get legal advice. Our guide to judgment debt explains what follows if a court case goes ahead.
Can the section 129 notice be a mistake?
Yes. Check whether you really are in default and whether the amount is right. If you believe the loan was reckless, that may be a point to raise. See reckless lending.
What happens if you fix the problem?
If you pay the arrears and permitted costs before the lender cancels the agreement or enforces it, the agreement is reinstated and carries on as if there had been no default. Ask for that in writing.
Where can you get free help?
- The Credit Ombud for disputes.
- The National Credit Regulator for registered debt counsellors.
- Legal Aid South Africa and law clinics for legal advice.
How do you read a section 129 notice?
The notice is dense, but it has a predictable shape. Check each part:
| Part | What to check |
|---|---|
| Lender and account number | Matches your agreement |
| Amount in arrears | Does it match what you believe you owe? |
| Date of the notice and delivery | The date matters for the 10 business days |
| The options listed | Debt counsellor, ombud, payment plan |
| Contact details | A way to reply and ask for a statement |
If the notice was sent to an address you no longer use, say so. Notices go to the address you gave in the agreement, which is why you should tell the lender when you move.
How are the 10 business days counted?
Business days exclude weekends and public holidays. Here is a hypothetical example, assuming the notice was delivered on Monday 3 March and there are no public holidays in the period.
| Business day | Date |
|---|---|
| 1 | Tuesday 4 March |
| 4 | Friday 7 March |
| 5 | Monday 10 March |
| 9 | Friday 14 March |
| 10 | Monday 17 March |
The lender can only start legal action after the ten business days have passed, so from Tuesday 18 March in this example. A public holiday in that period would move the date later.
Treat the date as the last moment to act, not the first. The earlier you reply, the more options you have.
What does it cost to reinstate the agreement?
If you pay the arrears and the permitted costs before the lender cancels or enforces the agreement, the credit agreement carries on as before. Here is a hypothetical example.
| Item | Amount |
|---|---|
| Three missed instalments of R1,200 | R3,600 |
| Permitted costs, such as a reasonable fee for the notice | about R150 |
| Amount to reinstate | about R3,750 |
Ask the lender for a written figure that shows how it is made up, and pay it into the account named in writing. Keep proof, and ask for a letter that confirms the agreement is reinstated.
If you cannot pay in one go, ask for a written arrangement that the lender accepts.
What can a debt counsellor do in the ten days?
A registered debt counsellor can assess your finances and, if you qualify, apply for debt review. That can change what the lender is allowed to do while the process runs.
The earlier you see a counsellor, the more time you have, because the assessment takes a little while.
Bring your ID, payslips, bank statements and the list of your debts. Check the counsellor on the NCR website first, and ask for fees in writing. Our guide to debt review explains the process, and what you give up.
What should you attach to your reply?
A reply works best when the lender can act on it. Include:
- Your account number and the date of the notice.
- What you propose: a payment of R___ on the ___, or that you have referred the matter to a debt counsellor.
- Proof of any payment you have made, and your latest payslip, if you are asking for an arrangement.
- A request for an up-to-date statement.
Send it by email or another method that leaves a record, and keep a copy. Section 129 notices are the lender’s required step. A written, timely reply is yours.
Frequently asked questions
Does a section 129 notice apply to payday loans?
It applies to credit agreements under the National Credit Act, so lenders of short-term credit must follow it too before going to court.
Can I ignore it if I plan to pay later?
It is risky. After the ten business days the lender can go to court. Contact the lender instead.
Is there a fee for a notice?
A lender may charge reasonable, permitted costs. Ask for a breakdown.
Does a section 129 notice mean I will be sued?
Not automatically. It means the lender may start a legal process if you do not act.
Does a public holiday count as a business day?
No. Business days exclude Saturdays, Sundays and public holidays, so a holiday in the period makes the wait longer.
What if the arrears grow while I wait for an answer?
Ask for an updated statement before you pay, because the figure can change. A written figure protects you.
